What are Intimate Images Charges in Canada?

In Canada, intimate images charges refer to the criminal offence of non-consensual distribution of intimate images under the Criminal Code of Canada.

What are “intimate images”?

An intimate image is a photo or video in which:

  • A person is nude, exposing genital or anal regions or breasts, or
  • A person is engaged in explicit sexual activity,
    and
  • The person had a reasonable expectation of privacy at the time the image was created.

The image does not have to be professionally made or shared online — private photos or videos qualify.

What makes it a criminal offence?

A person can be charged if they knowingly publish, distribute, transmit, sell, make available, or advertise an intimate image without the consent of the person shown in the image.

Key elements the Crown must prove include:

  • The image qualifies as an intimate image
  • The complainant did not consent to its distribution
  • The accused knew or was reckless about the lack of consent

 

Penalties for Intimate Image Charges in Toronto

In Canada (including Ontario), the penalties for intimate images charges (non-consensual distribution of intimate images) are set under the Criminal Code of Canada and depend on how the Crown proceeds.

How the offence is charged

This offence is hybrid, meaning the Crown can proceed:

  • By indictment (more serious cases), or
  • Summarily (less serious cases)

Maximum penalties

If prosecuted by indictment:

  • Up to 5 years in prison

If prosecuted summarily:

  • Up to 18 months in jail
  • and/or a fine of up to $5,000

There is no mandatory minimum sentence, but custody is possible depending on the facts.

A conviction can also include:
