To obtain a conviction for criminal harassment, the Crown must establish several key elements beyond a reasonable doubt. First, the prosecution must show that the accused engaged in conduct prohibited by the Criminal Code. This may include persistent following, repeated contact (direct or indirect), monitoring or lingering near places connected to the complainant, or behaviour that is threatening in nature toward the complainant or someone close to them.
Beyond the conduct itself, the Crown must demonstrate that the complainant experienced the behaviour as harassing. It must also be proven that the accused was aware the conduct was unwelcome, or was reckless or deliberately indifferent to how it was affecting the complainant.
In addition, the prosecution must establish that the behaviour caused the complainant to fear for their personal safety or the safety of someone they know. Finally, that fear must be shown to be objectively reasonable when all of the surrounding circumstances are taken into account.
No. The Crown does not have to show that the complainant suffered an actual injury or that a direct threat was made. Criminal harassment focuses on the impact of the accused’s conduct and whether it reasonably caused fear, not on whether measurable harm ultimately occurred.
The term “repeatedly” does not have a fixed numerical definition. It generally means more than isolated or occasional behaviour. Courts assess repetition based on the overall context, including the frequency, duration, and pattern of the conduct. What qualifies as repeated behaviour will depend on the facts of each individual case.
For conduct to meet the legal threshold, it must be unwanted and go beyond mere irritation or inconvenience. Criminal harassment typically involves behaviour that is persistent, troubling, or oppressive, and that the accused knew or reasonably should have known was unwelcome. The law requires more than simple annoyance; the conduct must rise to a level that reasonably causes fear or distress.
Courts apply an objective test when assessing fear. The question is whether a reasonable person, placed in the complainant’s position and experiencing the same circumstances, would have felt fear for their safety or the safety of others.
