How bail works in Ontario

In most bail hearings, the Crown must show why an accused person should be kept in custody. This is called the normal onus. Release is the starting point, and detention must be justified.
In some situations, the burden shifts to the accused. This is known as reverse onus bail. When reverse onus applies, the accused must show the court why they should be released rather than detained.
Reverse onus bail commonly arises in cases involving serious offences, weapons or firearms charges, certain drug trafficking offences, domestic violence allegations where there is a prior conviction, offences committed while already on bail, and situations where the accused is not ordinarily resident in Canada.
Reverse onus does not mean bail is impossible. It means the defence must come to court prepared with a strong bail plan, suitable supervision, and clear evidence addressing the court’s concerns about public safety, court attendance, and confidence in the justice system.
